2. GALGAL’S GRAND RAFFLE

This Galgal’s Grand Raffle Weekly Campaign (“Campaign”) and its related services is owned and operated by the Umuthu System Private Limited (“Galgal” or “Us” or our” or “We”) having its registered office at 710, Trade Centre, Opposite MTNL Building, Bandra Kurla Complex, Bandra East Mumbai – 400051. This Campaign terms and conditions applies to users (referred to as “user”, “users”, “your”, “you” or “Contestant(s)”) participating in the Campaign. By participating in and becoming a member of the Campaign, you are subject to all terms and conditions of this Campaign, which are in addition and subject to Galgal’s “Terms of Use” and “Privacy Policy” accessible at Galgal.money or its corresponding mobile application/ mobile site (collectively referred to as “Galgal”). By participating in the Campaign, you consent, agree and undertake to abide by and be bound to the Campaign terms and conditions. In any case, you wish to disagree with the terms and condition of this Campaign, please do not participate in the Campaign. Galgal, at its sole discretion reserves its right to modify or terminate the Campaign including the terms and conditions contained herein, in whole or in part, at any time and in any manner, whatsoever, without any obligation to provider any form or limitation to any of its users or Contestant(s)s.

By proceeding with the registration, the Contestant(s) hereby acknowledges to have read, understood, and agreed, on an irrevocable basis, to be legally bound by the most recent version of these Terms and Conditions in their entirety and all other applicable laws and regulations, without any limitation or qualification.

1. CAMPAIGN PERIOD

• The Campaign will be held between 21st June 2023 to 31st Dec 2023 and the results will be announced on or before 7 days within the conclusion of the Campaign.

• Galgal shall publish the list of winners on their mobile application or on the website of the Galgal accessible at Galgal.money. The Campaign winners may be asked to present their proof of identity.

2. ELIGIBILITY CRITERIA
   • In order to participate in the campaign, the Contestant(s) must be above 18 (eighteen) years of age, must be a citizen of India, must not have any criminal record nor should be of an unsound mind and must not be an employee of Galgal and its group companies, its affiliate or associate companies, or the relative of any such employee.

• This Campaign is subject to all applicable laws including but not limited to all the states except where such Campaigns are expressly banned by any such Statute/Notification of the Government (“Prohibited States”). Galgal shall not be liable for any loss or a legal action against such person who participates in the Campaign.

• The Contestant(s) hereby agrees that his/her failure to comply with the terms and conditions as set-out here in under and any other formalities stipulated by the Galgal during the Campaign Period shall disqualify him/her from participating in the Campaign.

3. CONDITIONS FOR PARTICIPATION

• To participate in the Campaign, the customer must deposit an amount equal to INR 2000 or more within the specified period before the beginning of such competition.

• Entries received after the stated closing date shall not be accepted.

• Galgal shall not accept responsibility for entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

4. SELECTION PROCESS FOR WINNERS
   • The winners of the Campaign will be selected on a random basis by virtue of a lucky draw that will be conducted in a fair and transparent manner.

• Galgal shall announce the names of the winners within 7 days from completion of this lucky draw, via a call or SMS at their registered contact number and shall require their confirmation to claim the eligible prize. The list of winners may also be published on the website/app and registered social media platforms. Once a confirmation is received via call/SMS from the winners along with a copy of a government identity card (inter alia Voter ID Card, Aadhar Card, and Driving License) of the winner(s) to confirm the details and address, the eligible reward shall be dispatched within 7 days of receipt of such details. The presentation of valid identity proof on request of Galgal shall be a necessary precondition to the dispatch of any prize.

• In the event the winners of a prize fail to respond to the Call/SMS sent by Galgal within a period of 15 (fifteen) days or are found to be ineligible or not in compliance with these terms and conditions, the winners will be deemed to have forfeited their right to claim the prize. In such cases, Galgal shall have an absolute right to select a new winner.

• Galgal ’s responsibility, therefore, shall be limited to informing the winners by call or SMS. Galgal shall not liable to send any follow-up call or SMS to the winners. In case the winner(s) do not receive a call or SMS from the Galgal regarding confirmation to claim their prize, it is their responsibility to inform/contact through the number and/or the e-mail address available on Galgal ’s Website.

• The Contestant(s) understands and agrees that by merely participating in the Campaign, he/she does not become eligible to claim the prize(s) and it is necessary for the participant to be selected and announced as a winner by the Galgal to claim the prizes mentioned here in below.

5. PRIZE DETAILS
   • The participants who emerge as winners based on the random lucky draw selection in the Campaign shall be entitled to (the prize). The prize shall be distributed in the following manner:

• Each winner shall be entitled to only 1 prize.

• The winner(s) of the above prize(s) cannot assign or transfer or exchange their respective prize(s).

• The prize is non-exchangeable and non-transferable. The gifts for winners are subject to availability and Galgal shall have the sole discretion to modify the gift product or to replace the gift with an alternative prize of equal or higher value if circumstances beyond make it necessary to do so.

6. LIMITATIONS OF LIABILITY AND RELEASE
   • By participating in the Campaign, the Contestant(s) agrees and confirms to indemnify Galgal from any and all claims, damages, or liabilities arising from or relating to your participation in the Campaign and waive all rights to claim any punitive, incidental, consequential, and/ or other damages.

• Galgal shall not be responsible for the quality of the goods distributed as prize(s) as these goods are not manufactured by it, and will further not be liable for any damage or defect to such goods or for any refund associated with the prizes.

• The income tax, gift tax or any other statutory tax liability that arises in connection with the prize(s) and is applicable from time to time will be solely borne by the winner(s) of the respective prize(s).

• No responsibility or liability whatsoever is assumed by Galgal for any technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Campaign:

• Hardware or software errors;

• Faulty computer, cable, satellite, network, electronic, internet connectivity or other online or network communication problems;

• Errors or limitations of any internet service providers, servers, hosts, or other providers;

• Garbled, jumbled, or faulty data transmissions;

• Lost, late, delayed, or intercepted transmissions;

• Unauthorized human or non-human intervention of the operation of the Campaign, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, or worms; or

• Destruction of any aspect of the Campaign, or loss, miscount, misdirection, inaccessibility, or unavailability of the contact number used in connection with the Campaign.

7. RIGHTS & OBLIGATIONS
   • The Galgal ’s decision with regard to the all the matters related to the Campaign will be final and binding on all Contestant(s)s. No further correspondence, appeals, protests, or attempts to dispute the decision will be entertained.

• The Galgal also reserves the right to extend or discontinue the Campaign or to cancel, change, amend or modify these Terms and Conditions including but not limited to the eligibility criteria, the participation, selection, and duration clauses, at any time during the Campaign Period, at our sole discretion, as may be required in view of any business exigency (ies), or any statutory or regulatory changes and all such changes and amendments shall be binding on the participants.

• The Galgal reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions.

• The winners and/ or their legal heirs shall not have any rights/ claims against the Galgal in addition to the prizes they are entitled to.

• The Galgal reserves all rights to disqualify the Contestant(s) if his/her conduct is contrary to the spirit or intention of the prize draw or competition.

8. FORCE MAJEURE

The Campaign is subject to any force majeure circumstances i.e. any event directly or indirectly resulting from any acts of God including but not limited to fire, flood, earthquake, or other natural disasters, an act of any sovereign including but not limited to war, rebellion, military or usurped power or confiscation, destruction or damage to property, riots, terrorist attacks, lockdowns, and lockouts by or under the order of any government or imposition of government law, judgment, order or decree, sanction, embargo or similar action, blockade, or labour dispute, epidemic, pandemics, accidents, strikes, explosions, or other similar or different contingencies which are beyond the control of the Galgal  which cannot reasonably be forecasted or provided against, and cannot be predicted by men of ordinary prudence. In case of any such force majeure conditions, no liability in whatsoever manner can be attributed to the Galgal.

9. GOVERNING LAW AND JURISDICTION

These terms and conditions shall be governed and construed in accordance with the laws of India and the courts in New Delhi shall have an exclusive jurisdiction to adjudicate any dispute arising out of this Campaign.
